Tenancy agreements and rules

All allotment tenants must comply with the current tenancy agreement, tenancy rules, site rules, written notices and any lawful instructions issued by MAMC or an authorised representative.

The tenancy rules cover matters including plot use, cultivation, co-workers, maintenance, water use, bonfires, rubbish, structures, site safety, gates, parking, rent, deposits, inspections, notices, termination and appeals.

A tenancy is personal to the tenant named in the agreement. It must not be assigned, sublet or transferred except where MAMC has given written agreement.

Rent, deposits and payments

Tenants are responsible for paying rent, deposits and any other charges due under the tenancy agreement and tenancy rules.

The rent year, payment deadlines, late payment consequences, deposit arrangements and refund conditions are set out in the tenancy rules and tenancy agreement.

MAMC may withhold deposit money where permitted under the tenancy rules, including where a vacated plot requires paid work or rubbish removal before it can be re-let.

Use of allotment sites

Allotment plots must be used in accordance with the tenancy rules.

Plots must be kept clean, safe and in a good state of cultivation. Tenants must use the plot for personal allotment use only and must not use it as a residence or sell produce for profit.

Tenants are responsible for their own safety, the safety of visitors and the actions of children, co-workers and invited visitors while on site.

Dogs, tools, structures, materials, water use, bonfires, rubbish disposal, gates, parking and shared paths must be managed in accordance with the tenancy rules and any site-specific notices.

Site access and security

Tenants must follow site access and security rules, including rules relating to gates, locks, keys, digital padlocks and authorised access.

Keys, access codes or site access arrangements must not be shared with unauthorised persons.

Inspections, notices and enforcement

MAMC or authorised representatives may inspect allotment plots and structures in accordance with the tenancy rules.

Where required standards are not met, MAMC may issue notices, including notices to clean and cultivate, notices of termination or other formal communications.

Termination and appeal procedures are set out in the tenancy rules.

Conduct

MAMC expects all tenants, co-workers, visitors, volunteers and committee members to behave respectfully.

Abuse, harassment, bullying, racist behaviour, violence, theft, trespass, deliberate damage, serious health and safety breaches or other serious misconduct may result in action under the tenancy rules, including termination of tenancy.
